- Country Club of the South Residents File Suit Against Its Homeowners Association to Prevent Merger with Country Club of the South Country Club
ATLANTA, MAY 9, 2007 – Residents of the prestigious Country Club of the South residential community today filed suit against its homeowners association, seeking to prevent a merger between the residential community and the similarly named Country Club of the South Country Club, a separate legal entity.
The suit was filed on May 4 in the Superior Court of Fulton County by the Residents’ Action Committee (RAC) against the Board of Trustees of the Country Club of the South residential community, the governing body of the homeowners association (HOA).
“Our objective is to continue to provide our property owners with the opportunity to join a country club of their choice or choose not to join any country club,” said Jim Bridges, chair of the RAC. “We are opposed to any merger of the residential community and the country club that would force all property owners to assume the financial and management responsibilities of the country club. We regret that we have been forced to resort to legal action to resolve this issue.”
The Country Club consists of a golf course designed by Jack Nicklous, a recently renovated clubhouse, plus tennis courts and other recreational facilities. Membership in the country club is currently not a requirement for home purchase. About 50 percent of current residents are not members of the country club.
